Cameron County Clerk – Assumed Name Certificate

Assumed Business Name/Doing Business As

Most banks require an assumed name certificate to open a business bank account.  It is necessary to obtain an assumed name certificate in every county where business will be conducted.

An applicant may conduct business under multiple assumed names, but each name must be filed separately.

Filing Process

ASSUMED NAME CERTIFICATE INSTRUCTIONS

TO REGISTER A BUSINESS NAME IN CAMERON COUNTY, THE FOLLOWING IS REQUIRED:

YOU MUST CHECK THE ASSUMED BUSINESS NAME (DBA) TO ENSURE THAT NO ONE IS CURRENTLY USING THE BUSINESS NAME. YOU MAY CHECK THE ASSUMED BUSINESS NAME ON OUR WEBSITE AT https://cameron.tx.publicsearch.us/ (Be sure to select Assumed names tab). THERE IS NO CHARGE TO SEARCH THE NAME ON THE WEBSITE. YOU CAN ALSO CHECK THE BUSINESS NAME IN PERSON AT ANY OF THE FOLLOWING OFFICES:

  • 835 E. LEVEE (3RD FLOOR), BROWNSVILLE, TEXAS 78520 OR;
  • 1390 W. EXPRESSWAY 83, SAN BENITO, TEXAS 78586

PLEASE NOTE THAT OUR OFFICE DOES NOT DO A NAME SEARCH BY TELEPHONE. A NAME SEARCH REQUESTED BY MAIL REQUIRES A $5.00 FEE FOR EACH NAME YOU REQUEST TO BE SEARCHED.

ONCE YOU HAVE VERIFIED THE NAME IS NOT BEING USED YOU CAN PICK UP THE FORM FROM OUR OFFICE OR PRINT IT FROM OUR WEBSITE BY clicking here.

FILL IT OUT AND HAVE THE ORIGINAL FORM NOTARIZED. YOU MAY TAKE THE ORIGINAL FORM TO A NOTARY OF YOUR CHOICE, OR THE OFFICE OF THE COUNTY CLERK CAN ACKNOWLEGE DBA FOR ADDITIONAL FEE. $5.00.

**   THE COUNTY CLERK WILL NOT ACCEPT THE ASSUMED NAME CERTIFICATE FOR RECORDING IF IT IS NOT PROPERLY ACKNOWLEDGED AND NOTARIZED

AFTER IT IS RECORDED. YOU MAY PURCHASE A PLAIN OR CERTIFIED COPY FOR YOUR RECORDS.  THE PLAIN COPY IS $1.00 PER PAGE AND THE CERTIFIED COPY IS $1.00 PER PAGE PLUS $5.00 CERTIFICAITON FEE.  PLEASE CHECK WITH YOUR BANK TO DETERMINE IF YOU NEED A PLAIN OR CERTIFIED COPY OF THE DOCUMENT. THE COUNTY CLERKS OFFICE ACCEPTS THE FOLLOWING PAYMENTS CASH, CREDIT/DEBIT CARDS OR CHECKS.   TEMPORARY CHECKS NOT ACCEPTED

MONEY ORDERS, PERSONAL OR COMPANY CHECKS ARE ACCEPTABLE, AND SHOULD BE MADE PAYABLE TO THE ORDER OF:

AN ASSUMED BUSINESS NAME IS GOOD FOR TEN (10) YEARS.

If you are no longer conducting business under an existing assumed name, you may file a Notice of Abandonment of Assumed Name Certificate.

Executing Assumed Name Certificates

Assumed Name Certificates must be executed by an officer, general partner, member, manager, or attorney-in-fact.

If an Assumed Name Certificate is executed by an attorney-in-fact, it must include a statement that the attorney has been authorized in writing by the attorneys’ principal to execute the certificate. (Texas Business & Comm. Code 71.104)

Changing Assumed Name Certificates

Assumed Name Certificates cannot be amended if there is incorrect information on the certificate, so please ensure all information is correct when submitting the Certificate.

If the information on the certificate changes becoming materially misleading, then the law requires an Assumed Name registrant to file a new Assumed Name Certificate. (Texas Business & Comm. Code 71.152)

An assumed name is not a business license.  Contact City Hall in the city in which business is to be conducted to find out if a business license is required in that city.
